The Caste and the Furious
The recent furore by the Gujjars over reservation-issue once again depicts the obvious; firstly the misuse of constitutional promise of egalitarian society and secondly the abuse of trust of people by democratically elected "trustees". That the so-called backward classes are exploiting the Constitution is exposed from the fact that just after independence every other lower classes of people wanted their community to be registered in the upper class category in order to achieve social status. However, gradually when they learnt that the government
is providing extra-ordinary educational and employment benefits to backward classes, the eternal fight for grabbing these opportunities began. Our trustees realized this as a hen laying golden eggs. Caste based reservation in education and employment sector became the heart and soul of political manifestos during pre-election campaigns. This came as blessing for richest and strongest of the backward community people. For them it was equivalent to the bonus of big MNC, a reward for member-hood of tolerant, nimble and dormant society. Over last 50 years, the constitutional promise of equality has been strategically and "democratically" exploited, misused and abused.I always ask this question: Do we really need to provide reservation in the present format or really need to reconsider? Is the today's India of common Indians really discriminating on caste basis, and if yes then who are the victims? Are "all persons" who sport titles like yadav, paswan, mahto, oh! and ofcourse meena are being discriminated? If we want to be honest then definitely answer is no.
I always ask this question: Is the caste the only criteria for reservation when the government boasts of poverty elimination and upliftment? Mandal said that no, caste is not soul but dominant criteria. Even if I take Mandal judgement as true as Mendelian Heredity theory yet, I do not understand why reservation is provided only on the basis of caste and religion? Has poverty and backwardness found their shelters only in the houses of Mahtos, paswans, tomars, toppos, sahas and I really don’t want to name all as I don’t know and I am sure even the Government doesn't know. Well if poverty is only situated there, by this time it should have been removed and today India would have measured highest GDP in the world!!!!! We all know poverty is "almost" evenly distributed across our great-land, yet reservation is meant only for those who can take the entire nation on rampage, block roads, destroy public property and indulge in every other "illegal glory".
I always ask this question: Does my 'backward' friend whose father is in administrative services, whose father is a doctor; whose father is engineer in an MNC is really being discriminated? Is he really poor and downtrodden? Is he being tortured everyday by his society? Somebody said, "NO". Thanx. If so then why did my friend write the same entrance test in reserved category and why did I write in General category? Have I gone insane? Has he gone insane? Or we all have gone insane that we do not know what we are doing to our society, our country, our economy social and political.
I always ask this question: When someone who scores only 22 out of 200 in an entrance test for professional education, why should he be chosen at the expense of another candidate who scored 106 out of 200? What wrong he did? Has he done any offence because his father bore a title, named "JHA".
I always ask this question: Do we have any remedy? Can we do something? Can our political institutions act as true "trustees" Can Bhagwandas Road act as true "Bhagwan" and give panacea for this disease?

Hi anand, thanx 4 your comments.
This is wat actually I was expecting frm JP...A cut-throat lawyer's analysis.
2 problems has been pointed out & I must add that...Yes!!!those r d only 2 issues which r actually bothering...
1. The problem of identifying & seggregating d 'creamy-layer'.
2. Determining d criteria fr reservation: caste? poverty? education? or what?
Both of the issues are an amalgamation of Law n Politics...To my mind, d Bhagwan of Bhagwan Dass Road has to play a role as much as d 'trustees' have to play...Reciprocity between d 2 wings of democracy is wat v need...
GHOSH...
well really thought provoking and so very true....
some remedy, some action is a must as a SOS
Barsha
I think its the settled position of law that reservation is not available to the 'creamy law' in the same manner in which it is available to the lesser privileged sections.
